1. Who you are contracting with

Pedal Bench (the "Service") is provided by Amped Strings Inc, a California S‑Corporation ("we", "us", "our"). By creating an account or otherwise using the Service, you ("you", "user") agree to these Terms. You confirm you are of legal age in your jurisdiction and, if acting on behalf of an organization, have authority to bind it.

2. The Service

Pedal Bench is a web-based workbench for designing, simulating, and sharing guitar pedal and audio circuit projects. Features available to you depend on your plan (Free or Pro).

3. Accounts

You must provide accurate information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account.

4. Acceptable use

You must not, and must not attempt to:

  • Use the Service for unlawful purposes, fraud, spam, or to harass others.
  • Infringe the intellectual property or privacy rights of others.
  • Upload malware, probe, scan, or attempt to breach security, or scrape the Service without permission.
  • Reverse engineer, resell, or redistribute the Service except as allowed by law.
  • Circumvent technical limits or use the Service to build a competing product.

5. Your content

You retain ownership of projects, designs, comments, and other content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your content solely to operate and improve the Service and to deliver it to you and the audiences you choose. You are responsible for having the rights to anything you upload.

6. Intellectual property

We and our licensors retain all rights in the Service, including its software, design, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service within the scope of your plan.

7. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for our refund window.

Subscriptions renew automatically until cancelled. Cancelling stops future renewals; you retain Pro access until the end of the current paid period.

8. Service availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time.

9. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service and delete your account at any time. On termination, your right to use the Service ends and we may delete your content after a reasonable export window.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement. Simulation results, component data, and educational content are provided for general purposes and are not a substitute for professional engineering judgment.

11. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, personal injury, or any liability that cannot be excluded by law.

12. Indemnity

You will indemnify and hold us harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.

13. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Ventura County, California, unless otherwise required by mandatory consumer law.

14. Changes

We may update these Terms. Material changes will be communicated in-app or by email. Continued use constitutes acceptance.
